Terms of use

Last updated: [Last updated date] · Effective: [Effective date]

These terms govern the use of RecruitFlow AI, a service operated by [Company legal name] (“we”, “us”). Sections 1 to 15 apply to business customers: the carrier that signs up (the “Customer”) and every person it invites. Section 16 applies to job applicants using an application page.

By creating an account, accepting an invitation or using the service you agree to these terms and to the privacy policy. If you use the service for a company, you confirm that you may bind that company to these terms.

1. The service#

RecruitFlow AI helps trucking carriers recruit drivers. It turns a recruitment offer into draft ad copy and banners, checks every claim against the offer facts the Customer entered, routes drafts for approval, and, where the Customer has connected its own ad accounts and switched publishing on, publishes and reports on approved campaigns on Meta, Google Ads and job boards. It also collects applications from drivers who respond to those ads, for the Customer to review.

Some features run in a simulated (“mock”) mode, clearly labelled in the app, that does not contact any ad platform or spend money. We may change or improve features over time.

2. Accounts and security#

  • Each user needs their own account; do not share sign-in details.
  • Keep passwords and recovery codes safe and turn on two-step verification. Owners should require it for every member who can approve or publish.
  • The Customer is responsible for who it invites, the roles it gives them and everything done under its accounts.
  • Tell us promptly at [Contact email] if you suspect unauthorized access.

3. Customer responsibilities#

The Customer is responsible for its recruiting and advertising, including that:

  • Offer facts are accurate: pay, bonuses, home time, equipment, requirements and contact details entered into the service are true, current and available to the drivers who respond.
  • Employment advertising law is followed, including federal and state equal employment opportunity law (no ads that state or imply a preference based on race, color, religion, sex, national origin, age, disability or another protected characteristic), state pay-transparency rules and truth-in-advertising rules for earnings claims.
  • Background checks and consumer reports on applicants, if any, are obtained in line with the Fair Credit Reporting Act and similar state laws. The service does not run background checks.
  • Platform rules are followed, including Meta’s Special Ad Category for employment ads (which limits targeting by age, gender and narrow location) and Google’s advertising policies. The Customer remains responsible for its ad accounts and for complying with each platform’s terms.
  • Applicants are contacted lawfully: calls and texts follow the Telephone Consumer Protection Act, state telemarketing laws and the consent the applicant gave, and opt-out requests (including replies of STOP) are honored promptly.
  • Applicant information is used only to recruit for the Customer and handled as the law and our privacy policy require.

4. AI-generated content#

Ad copy, image concepts, campaign plans and recommendations are drafts produced with AI. Automated checks compare drafts with the offer facts, and banner amounts and phone numbers are drawn from those facts by our own software, but drafts can still be wrong, incomplete or unsuitable. The Customer must review every draft before approving it and is responsible for the content it approves.

Recommendations about budgets or campaigns are suggestions only; nothing changes until a person applies them.

5. Approvals and publishing#

  • Nothing is published to an ad platform or job board without the Customer’s approval. Approvals apply to a specific version; any later edit needs a new approval.
  • Live publishing also needs a connected live ad account and the Customer’s publishing switch to be on. Automation (scheduled starts, auto-pause) acts only within the campaign configuration the Customer approved.
  • The Customer can pause or stop campaigns at any time in the service or directly in its ad accounts.

6. Ad spend and fees#

Ad spend is charged by Meta, Google and job boards directly to the Customer’s own ad account and payment method, under the Customer’s agreements with those platforms. We do not pay for, collect or refund ad spend, and we are not responsible for platform charges, ad rejections or account restrictions.

Budget limits in the service are safeguards, not guarantees; set spending limits in the ad platforms as well. Fees for RecruitFlow AI itself, if any, are set out in the Customer’s order or agreement with us.

7. Acceptable use#

Do not use the service to:

  • advertise jobs that do not exist, misrepresent pay or conditions, or collect applicant information for anything other than hiring;
  • discriminate unlawfully or target ads in ways the law or platform rules forbid;
  • send spam or contact people without the consent the law requires;
  • upload content you have no right to use, or content that is unlawful or infringing;
  • probe, disrupt or overload the service, get around its security or approval controls, or access other organizations’ data;
  • resell the service or use it to build a competing product.

We may suspend access to stop a violation or protect the service and its users.

8. Intellectual property#

The Customer keeps all rights in its content: offers, logos, brand material and the ads and banners generated for it. The Customer gives us permission to host, process and display that content, and to send it to the providers and platforms described in the privacy policy, only to provide the service.

We keep all rights in the service, its software and design. Feedback you give us may be used to improve the service without obligation to you.

9. Confidentiality and data protection#

Each party will keep the other’s non-public information confidential and use it only for this relationship. We process applicant information on the Customer’s behalf as described in the privacy policy, and we act as a service provider under the California Consumer Privacy Act: we do not sell or share that information, or use it for any purpose other than providing the service.

10. Third-party services#

The service works with third-party services (Meta, Google, Indeed, AI providers). Their availability, policies and decisions are outside our control, and the Customer’s use of them is governed by its own agreements with them.

11. Disclaimers#

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any number of applicants, hires or ad results, or that drafts are free of errors, and nothing in the service is legal advice.

12. Limitation of liability#

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability arising out of these terms or the service is limited to the fees the Customer paid us for the service in the 12 months before the claim. These limits do not apply to a party’s fraud or wilful misconduct, or where the law does not allow them. The Customer will defend and indemnify us against third-party claims arising from its ads, its offer facts or its contact with applicants.

13. Suspension and termination#

The Customer may stop using the service and ask us to close its account at any time. We may suspend or end access for a material breach of these terms, or to comply with law. When an account is closed, its campaigns are no longer managed by the service (pause them in the ad platforms if they are still running) and its data is deleted as the privacy policy describes. Sections that by their nature should survive (such as 8, 9, 11, 12 and 14) survive termination.

14. Governing law#

These terms are governed by the laws of the State of [Governing law state] and applicable US federal law, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts located in [Governing law state], and each party agrees to their jurisdiction.

15. Changes and contact#

We may update these terms. We will post the new version here with a new date and, for material changes, tell business customers by email or in the app before they take effect. Continuing to use the service after that means you accept the new terms.

Questions: [Company legal name], [Company postal address], [Contact email].

16. Terms for job applicants#

If you use an application page to apply for a driving job:

  • The job is offered by the carrier named on the page, not by RecruitFlow AI. The carrier decides whether to contact or hire you, and job details are the carrier’s responsibility.
  • Give accurate information about yourself, apply only for yourself, and use a phone number that is yours.
  • By submitting, you agree that the carrier may call and text you about the job as described on the form. You can opt out at any time by replying STOP to a text or as described in the privacy policy.
  • Do not misuse the form (automated submissions, false or someone else’s details).
  • How your information is handled is explained in the privacy policy, and you can ask for it to be deleted as described on the data deletion page.
